Dana Tokmurzina, General Director of Fortune Partners and a former judge of the Supreme Court of Kazakhstan, spoke at the session "Court Practice in Antitrust Cases: Disputes, Evidence, Defence"

The session addressed:

  • how courts approach antitrust disputes and what they look at first;
  • which evidence works and which the courts reject;
  • how a business should build its defence during antitrust investigations;
  • trends in court practice and the direction enforcement is taking in Kazakhstan.

The figures speak for themselves:

The number of claims fell from 302 in 2022 to 194 in 2025 — a drop of 38%.

The share of claims upheld in companies' favour fell from 64% to 50%. The Agency for Protection and Development of Competition attributes this to having addressed earlier shortcomings in its own work and to operating more effectively as a result.

Settlement rates remain low — 4% of cases, against 16% across other categories of disputes nationally.

Antitrust enforcement is becoming steadily more active, and businesses need to understand the rules of the game before a dispute begins.
