Dispute resolution
Our team has significant experience representing clients in pre-trial and trial dispute resolution. Members of our team have previously served as judges of the Supreme Court of Kazakhstan and first instance courts for administrative and civil cases.
In public matters, taking into account the experience of our colleagues in the state revenue bodies, we successfully represent clients in tax, customs, environmental, antitrust, and other disputes. We have experience in peacefully resolving disputes with government agencies (in pre-trial procedures and through settlement agreements in court).
In commercial disputes, we represent clients' interests in courts and arbitration, regardless of their status in legal relationships (customer, contractor, buyer, seller, etc.), including in unusual situations.
We have successful experience in protecting clients' interests in rehabilitation and bankruptcy procedures, supporting enforcement proceedings, consulting on international arbitration, and multi-jurisdictional disputes.
Environmental issues
The current Environmental Code of the Republic of Kazakhstan has tightened requirements for businesses: operator liability has been increased, and new requirements have been introduced for Category I facilities. Violations of environmental legislation can result in significant fines (including the amount of economic benefit) and the suspension of enterprise activities.
Members of our team have unique experience representing industrial enterprises in multi-billion-dollar environmental disputes. We also have a successful track record in challenging environmental inspections regarding excess emission/discharge standards, the absence of pollutants in project plans, and waste management issues.
In addition to supporting and appealing environmental inspections, we provide clients with consultation on any issues related to environmental legislation, potential risks, and assist in obtaining environmental permits.
Corporate / M&A practice
We assist our clients in determining the form of business operations, preparing founding documents, registering legal entities, making corporate decisions, and acquiring new assets.
Members of our team have experience supporting M&A transactions of varying complexity, including drafting documents for acquiring shares/participation interests, obtaining necessary approvals from authorized bodies, supporting negotiations, and re-registering legal entities.
A key area of our M&A practice is conducting comprehensive due diligence on acquired assets. Our team’s multidisciplinary experience allows us to perform thorough due diligence for companies in any economic sector (subsoil use, industry, trade, agriculture, financial sector), assessing not only legal but also financial, tax, and accounting aspects.
Criminal legal protection of business
Our team includes specialists with experience in the prosecutor's office (at the regional level and the General Prosecutor's Office of the Republic of Kazakhstan), as well as lawyers with a successful track record of defending large business entities against criminal prosecution.
This expertise allows us to effectively protect and represent business interests in criminal cases, including economic and tax crimes, accusations of embezzlement of budget funds in public procurement, abuse of authority, and dissemination of knowingly false information.
Our specialists have experience conducting internal investigations to identify criminal offenses committed by employees against company property (theft), as well as the dissemination of trade secrets. This includes preparing evidence, and providing support in law enforcement agencies and in court.
